Illegality of Yemen's Maritime Blockade by way of Scrutinizing the Characteristic of Armed Conflict in the said state

چکیده مقاله

Yemen ' s maritime blockade began with the presence of Saudi Arabia led coalition naval forces in 2 0 1 5 in the waters of Yemen and continues to these days . The prohibition of arriving the humanitarian aid, the lack of medicines and medical facilities , the lack of fuel, the severe starvation , the spread of illnesses , including cholera, and finally the destruction of thousands of Yemeni civilians as a consequence of this naval blockade , need to investigate the legality or illegality of the blockade under international law . The present topic has sought by descriptive-analytical method and with regard to collecting mainly qualitative research information by library method and in the form of using documents, books, authoritative articles and related websites. The legal studies state that armed conflict between the Yemeni government or the coalition forces led by Saudi Arabia with the Ansarallah Movement People's Committees and parts of the Yemeni army is non-international armed conflict and so, the blockade is illegal. In addition to the blockade breaches the international humanitarian law, such as the San Remo instruction and the Second Additional Protocol to the Geneva Conventions of 1949.
